FIXED TELECOMMUNICATION NETWORK SERVICES LICENCE
TELECOMMUNICATION ORDINANCE (Chapter 106)


In accordance with General Condition 20 of Fixed Telecommunication Network Services Licence, Cable & Wireless HKT Telephone Limited, Cable & Wireless HKT International Limited and Cable & Wireless HKT CAS Limited (collectively referred to as “the Company”) hereby publishes the tariffs, the terms and conditions under which it will provide the following telecommunication service during 1st June 2000 to 31st July 2000.

* The Free Trial is provided under a first come first served basis and can cater for around 5,000 customers.

Special Conditions for U-Mail Service

The U-Mail Service (the “Service”) is a service made available by the Company to the Customer subject to the Company's General Conditions of Service and these Special Conditions.

If any of these Special Conditions are inconsistent with the General Conditions of Service these Special Conditions will prevail.

Capitalised terms in these Special Conditions have the meanings given to them in Clause 8 of the General Conditions of the Service as applicable.

U-Mail Service

The Service provides the Customer with a unified messaging service by providing an integrated mailbox for voice, facsimile and email services.

The Service consists of a allocated U-Mail number and a U-Mail email account which are accessed by the use of a PIN. While the Customer can nominate only one fixed line service to be linked directly to the U-Mail number, the Customer can call forward any number of voice (both mobile and fixed) or facsimile services to the allocated U-Mail number and can also forward other email addresses to the U-Mail email account.

The service provided by CWHKTC to the Customer can be accessed using either a phone or a web browser and allows the Customer to hear voice messages either over the phone or through the multi-media system of a PC. The Customer can also view stored faxes over the Internet. The Service will also store email messages and allow the Customer to send, receive, reply and forward email from the Customer's U-Mail email account. In addition the Service also enables the Customer to direct emails to a particular fax machine or to listen to stored emails through a phone through the use of a text to speech synthesiser.

The Service can notify Customers of messages by sending a particular dial tone to the fixed line service to which the Service has been linked. In addition the Customer may choose the option of having short message service sent to their mobile phone to alert them to the arrival of particular classes of messages. In order to support this functionality Customers must have access to short messaging services on their mobile network.

Customer's Responsibilities

In order to obtain access to the Service a Customer must have a current fixed line service provided by CWHKTC and must nominate that fixed line service to be linked to the Service.

If a Customer wishes to change the fixed line service linked to the Service at any time the Customer must notify CWHKTC and allow 7 working days for the change to occur.

U-Mail Security and Resources

The Customer is required to input the PIN or any other information as specified by the Company in order to obtain access to the Service. The Customer shall be responsible for maintaining the confidentiality of such PIN or information and shall be fully responsible for all activities in respect of the Service which are accessed through the use of the information or PIN. The Customer hereby agrees to immediately notify the Company of any unauthorised use of account or any other breach of security. The Company shall not be liable for any loss or damage arising from the failure of the Customer to comply with these conditions.

The Customer acknowledges that the U-Mail number and U-Mail email address (“U-mail Resources”) allocated by the Company to the Customer for access to the Service shall remain the property of the Company and the Customer has no right and title thereto. The Company reserves the right to withdraw any of the U-Mail Resources at any time and the Customer acknowledges that any U-Mail Resources must be returned on expiry or termination of the Service.

Use of Service

The Customer shall ensure that:

  1. he/she does not use or allow others to use the Service to create, distribute or make available junkmail, chain letters or the transmission of any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, malicious, fraudulent, harassing, threatening, harmful, racist or otherwise objectionable material of any kind or nature;
  2. he/she will not harvest or collect information about others including email addresses;
  3. he/she will not transmit any material that may infringe the intellectual property rights of other parties including but not limited to trademark or copyright;
  4. he/she will not attempt to gain unauthorised access to the Service, other accounts, computer systems or networks connected to the Service through any means;
  5. he/she will not use the Service for any activities that are or may be viewed as unethical, immoral or illegal;
  6. he/she will not interfere with other Customers’ use and enjoyment of the Service;
  7. he/she will not email or transmit any material that contains software, viruses or any other computer code, files, or program designed to interrupt, destroy or limit the functionality of any computer software, hardware or telecommunications equipment;
  8. he/she will abide by all rules, regulations, procedures and policies of the Service as notified to the Customer from time to time.

Termination

The Customer acknowledges that the Company shall be entitled to terminate the Service immediately should the Customer be in breach of these Special Terms and Conditions or should the Customer cease to subscribe to the CWHKTC fixed line service to which the Service is linked.

Charges

The Customer acknowledges that the Charges payable for the Service do not include any charges that may be payable by the Customers for the optional short messaging service which is provided by the Customer's mobile operator and which does not form part of the Service.

Storage Limits

The Customer acknowledges that the Company has set an upper limit of storage space in relation to the Customer's U-Mail message box:

  1. a maximum of 20 voice/fax message or 100 pages of facsimile
  2. a maximum of 5 megabytes for email messages

The Customer also acknowledges that the Service is only capable of storing individual facsimile messages of 20 pages or less and voice messages of less than 1 minute duration. The Customer also acknowledges that the Service cannot store attachments over 2 megabytes.

Further the Customer acknowledges that where a facsimile or voice message has been read by a Customer and saved in the Service the maximum storage time for that message is 30 days. On expiry of 30 days all saved messages will be deleted.

Company's Responsibilities

The Company will provide the Customer with a U-Mail number, a U-Mail email account and a PIN.

The Company reserves the right to:

  1. deactivate the Service at any time without notice to carry out system maintenance, upgrading, testing and/or repair;
  2. limit or suspend the Customer's access to the Service without notice where it is of the opinion that such action is appropriate as a result of the Customer's use of the Service;
  3. monitor, or disclose the contents of the Service where required by law to do so, or where the Company believes that such disclosure is necessary to (i) comply with legal process, (ii)enforce the terms and conditions and (iii) respond to claims of infringement of rights of any third party;
  4. amend these Special Conditions of Service at any time.

Warranties & Liabilities

The Customer acknowledges and agrees that the Company has no control over the content of any transmission to or from the Service and accepts no liability for any transmitted content. The Customer accepts that any data or information downloaded or otherwise obtained through the use of the Service is at the Customer's sole risk and discretion and that the Company will not be liable for any damage or loss to the Customer, the Customer's computer, content stored within that computer and other property or the loss of data or material arising out of such information or data.

To the extent permitted by law, the Company disclaims any representation or warranty, whether expressed or implied as to the title, merchantability or fitness for a particular purpose of the Service. The Company makes no warranties that the Service will meet the Customer's requirements or that the Service will be uninterrupted, timely, secure or error free. In particular the Company makes no warranties as to the accuracy or reliability of the results obtained by the use of the Service or as to the reliability, accuracy or completeness of any communication or transmission sent to or from the Service. In addition the Company makes no warranties as to the quality, completeness or accuracy of any text to speech conversion.

The Company accepts no liability for the delay or failure to transmit or to store a message or the deletion of messages and in no event shall the Company be liable to the Customer or any third party for any indirect, incidental, special or consequential loss resulting from the use of or the inability to use the Service.
