1.0 Personal Number Service
Personal Number Service is a service offered by New World Telephone which allows subscribers to receive all their calls on one personal telephone number (Personal Number), and to route such incoming calls to one or more numbers of their choice, including pager, office, home, mobile phone and other numbers. If a subscriber cannot be reached at his pre-programmed numbers, the calling party may choose to leave a voice message for the subscriber. The normal service provision time for New World Telephone's Personal Number Service is 3 working days.
1.1 Service Features
Priority Number
The Priority Number is the main number programmed by the subscriber to update the subscriber's present location. Any incoming call to the subscriber's Personal Number is first routed to this Priority Number before being routed to the other numbers programmed by the subscriber. For the present time, the Priority Number must be an 8 or 9 digit local number.Sequential Hunting Numbers
Sequential Hunting Numbers are the other numbers, up to a maximum of 4, which are programmed by the subscriber and are 'hunted' by the Personal Number Service whenever the subscriber cannot be reached at his Priority Number. The Personal Number Service attempts to reach the subscriber at each of the Sequential Numbers in order of the priority programmed by the subscriber. For the present time, the Sequential Hunting Numbers must also be 8 or 9 digit local numbers. A variation to the Personal Number Service will be introduced shortly allowing callers to choose which of a subscriber's office, secretary, mobile or home numbers to hunt.Pager Number
If an incoming call cannot reach a subscriber at either the subscriber's Priority Number or Sequential Numbers, the caller may choose to be transferred to a paging service designated by the customer. Subscribers may also choose to give callers the choice of accessing the paging service if the subscriber cannot be reached at the Priority Number, prior to searching the Sequential Numbers. If the paging service used by the subscriber is not a secretarial service type, the Personal Number Service will inform the caller of the appropriate account details to the caller before routing to the paging service.Call Screening
A subscriber may build up a call screening table of up to 10 numbers used to screen incoming calls when the Call Screening feature is activated. Only if the incoming caller's Call Line Identity (i.e. telephone number) matches one of the numbers on the call screening table, or the incoming caller inputs a telephone number on the call screening table, will the incoming call pass to the call hunting procedure. In this way subscribers can restrict caller access in special situations.Language
Subscribers may select either Cantonese or English at the time of registration for use during programming of their Personal Numbering Service. Dual language prompts are offered to incoming callers.Voice Mail Service
Voice mail service is also a standard feature offered to subscribers. Subscribers can program the Personal Number Service to offer Voice Mail Service to incoming callers after only the Priority Number has been hunted, or after all the Sequential Numbers have been hunted.Out-of-Town Service
Whenever the Out-of-Town Service is turned on incoming calls will immediately be routed to the subscriber's voice mail box.Password Number
Subscribers are required to input a 4-digit security Password Number when programming call management features on their Personal Number Service.
1.2 Charges
Basic Charges
Charges for the Personal Number Service package are as follows:

During a promotional period valid unit February 1996, the one-off registration free is waived, and subscribers may choose either to pay 3 months Monthly Service Fee for 4 months usage (1 free month), or 10 months Monthly Service Fee for 12 months usage (2 free months).
1.3 Terms and Conditions of Service
The Subscriber will observe and be bound by the following terms and conditions in relations to the provision of the Personal Number Service and Value Added Service by New World Telephone: Definitions:
- 'Order Form'
- means the Personal Number application order form which the Subscriber completes and signs in subscribing to the PN Service. Subscriber's signature to this Order Form shall mean that the Subscriber agrees to be bound by the terms and conditions herein;
- 'Call Management Service'
- means a service which entitles the Subscriber to access the PN Service Platform in order to change his or her personal number call profile;
- 'Charges'
- means the charges for using PN Service as set out in NWT's tariff table and which may be changed from time to time by NWT;
- 'Condition of Service'
- means the terms and conditions for the use of NWT's IDD;
- 'IDD Call Forwarding Service'
- means a call forwarding service which entities the Subscriber to be contacted at an overseas telephone number. Whenever the Subscriber receives a telephone call at an overseas telephone number through the IDD Call Forwarding Service, the costs of such calls shall be born by the Subscriber at the prevailing NWT's IDD rates;
- 'Invoice'
- means a statement issued by NWT to the Subscriber setting forth all subscription fees and/or all value added service charges;
- 'NWT'
- means New World Telephone Company Limited or any subsidiary or any associated company of NWT, as the case may be;
- 'Personal Number'
- means the number assigned to the Subscriber for the purpose of using the PN Service;
- 'PN Service'
- means a Personal Number Service whereby the Subscriber is assigned a Personal Number through which he or she can be contacted by telephone;
- 'Subscriber'
- means the customer who subscribes to the PN Service and agrees to the terms and conditions to its usage;
- 'User Guide'
- means any brochure, customer guide or other literature published by NWT from time to time in connection with the provision of the PN Service;
- 'Value Added Service'
- means any chargeable service used in conjunction with the PN Service (including any IDD Call Forwarding Service).
1. The Subscriber acknowledges as a condition of this Agreement that all information furnished by him to NWT in his Order Form to NWT for PN Service and other services are true and correct. The Subscriber further agrees to inform NWT of any change in his name, address, contact telephone number, contact person (if applicable), payment method or signature as soon as practicable, but not later than thirty (30) days of such change.
2. The Subscriber's submission of a completed and signed Order Form shall mean that the Subscriber agrees to all of the provisions set forth herein.
3. NWT may refuse to provide the PN Service and/or its Value Added Service to the Subscriber which, in the opinion of NWT, is used or intended for any illegal purpose or suspected illegal purpose. If any illegal use of PN Service and its Value Added Service is discovered after the Order Form has been signed by the Subscriber, NWT reserves the right to terminate the PN Service and its Value Added Service at any time without giving prior notice or compensation to the Subscriber.
4. Upon completion of the Order Form and subject to payment in full by the Subscriber of all applicable charges and fees, the Subscriber shall be assigned a Personal Number. If the Personal Number has been, for any reason, assigned to the Subscriber prior to the Subscriber completing the Order Form and/or paying in full the sums referred to above, then notwithstanding such assignment, NWT shall not be obliged to provide the PN Service to the Subscriber, and shall entitled to cancel the Personal Number assignated to the Subscriber.
5. The charges for the PN Service and any associated Value Added Service under this Agreement are subject to NWT's prevailing rate of charges from time to time. NWT reserves the right to vary the rate at any time as it thinks fits. The Subscriber is responsible for payment of all charges levied by NWT in respect of the provision of the PN Service and its Value Added Service.
6. An Invoice setting out the charges for the relevant month or billing period payable by the Subscriber shall be sent to the Subscriber. The Subscriber shall, punctually pay the service charge in advance to NWT for the provision of PN Service and any Value Added Service. Unless otherwise specified, NWT's Invoice for the service charges and any Value Added Service charges are due for payment within thirty (30 calendar days from the date of Invoice. All payments shall be paid in Hong Kong Dollars and the Subscriber may make payment by cash, auto-pay, cheque or credit card.
7. Payment sent by post shall be at the risk of the Subscriber and an Invoice shall not be deemed to have been paid until payment is received by, NWT.
8. In the event of any disputes between NWT and the Subscriber relating to any charges billed by NWT, the books and records of NWT shall be conclusive evidence in settling any such disputes.
9. The monthly service charge payable by the Subscriber to NWT shall commence from the service commencement date specified in the Order Form.
10. Provisions of IDD Call Forwarding Service is subject to the Conditions of Service which may change from time to time.
11. No receipt shall be valid or binding on NWT unless it bears the chops and usual signatures of the authorized officers of NWT or is made on the standard computer printout receipt of NWT.
12. NWT shall have the right to forthwith terminate this Agreement or temporarily disconnect the PN Service and the Value Added Service at any time if: any charges or sums payable hereunder remain unpaid after becoming due; the Subscriber commits a breach of any of the terms and conditions contained herein; or the Subscriber or any other person uses the PN Service for illegal or improper purpose or use abusive.
13. Termination hereunder shall be without prejudice to any then existing rights and/or claims that NWT may have against the Subscriber, and shall not relieve the Subscriber from fulfilling its/his obligations including payment of all outstanding charges prior to the date of termination.
14. Upon termination of this Agreement, NWT shall have the right to assign the Subscriber's Personal Number to another Subscriber of NWT. Subscriber may not have the right to obtain his previous Personal Number from NWT should he/she subscribe for the PN Service again after termination.
15. Either NWT or the Subscriber may terminate this Agreement for whatever casue by giving to the other party thirty (30) working days prior written notice to that effect.
16. In the event that PN Service is disconnected under Clause 11, Clause 14 or any other reasons, NWT may upon the Subscriber's request, but subject to NWT's sole discretion and payment by the Subscriber of all outstanding charges and sums, reconnect the PN Service. The Subscriber shall pay the service charge in advance and a reconnection fee at NWT's prevailing rate for such reconnection.
17. In the case of the Subscriber being a limited company, the Order Form must be signed by a director, company secretary or other authorized officer of such company. In case of the Subscriber being a firm or organization other than a limited company, the Order Form shall be signed by the proprietor or a partner of the firm or an authorized officer of the organization. NWT reserves the right to request the Subscriber to produce a copy of his/her business registration certificate. Individual Subscriber must be over the age of eighteen (18) to sign the Order Form. NWT reserves the right to request a copy of the Subscriber's identity card and/or obtain a personal guarantee.
18. The Subscriber cannot transfer any of its right and obligations under this Agreement to another party without the prior consent of NWT. Consent will only be given to NWT on condition that the Subscriber and the transferee sign a transfer Agreement in the form specified by NWT and Subscriber settles all outstanding charges under this Agreement.
19. NWT reserves the right at any time to vary, delete any or all of the terms and conditions herein or add new terms and conditions to this Agreement without giving any prior notice to Subscriber.
20. NWT shall not be deemed to be in breach of any provision of the Agreement by reason of any delay in performing, or any failure to perform, any of NWT's obligation if such delay or failure is due to causes beyond NWT's reasonable control. In no event shall NWT be liable to Subscriber for any consequential damage or indirect loss which may be incurred under this Agreement including, without limitation, loss of revenue, profits or contracts.
21. No forbearance, delay or indulgence by NWT in enforcing the provisions of this Agreement shall prejudice or restrict the rights of NWT nor shall any waiver of its rights operate as a waiver of any subsequent breach and no right, power or remedy herein conferred upon or reserved for NWT is exclusive of any other right, power or remedy available to NWT and each such right, power or remedy shall be cumulative.
22. NWT shall not be liable for any loss, damage or delay to the Subscriber due to strikes, lock-outs, shortage of labor or materials, disputes, fire, theft, storm, explosion, war, civil commotion, acts of God or any other circumstances beyond its reasonable control howsoever arising or howsoever caused.
23. NWT shall not be liable for any direct or indirect loss due to improper usage by the Subscriber on the PN Service. NWT is not responsible for preventing any possible nuisance calls to the Subscriber's PN Service.
24. If at any time any provision of this Agreement is or becomes illegal, invalid or unenforceable in any respect, such provisions shall be severed from this Agreement, and the remainder of the provisions of this Agreement shall not be affected or impaired thereby.
25. This Agreement shall be construed in accordance with the Laws of Hong Kong and the parties shall submit to the exclusive jurisdiction of the courts of Hong Kong in the event of dispute.
26. This Agreement embodies the entire understanding between the parties and there are no promises, terms or conditions, oral or written expressed or implied other than those of this Agreement.
27. This Agreement shall be governed by and construed in accordance with Hong Kong Law.
28. In the event of any discrepancy between the English and Chinese versions of this Agreement, the English version shall prevail.
The Chinese version of this Personal Number Service and Value Added Service Agreement is available upon request.
2.0 IDD 009 International Calling Service
IDD 009 is an international calling service offered by New World Telephone allowing residential and business subscribers quick and easy access to overseas destinations. The service may be used for both voice and fax communication. Normal service provision time for New World Telephone's IDD 009 is 3 working days.
2.1 Service Registration
Customers may obtain a subscription form for IDD 009 from any New World Telephone retail shop or by dialing the New World Telephone hotline on 123.
2.2 Dialing Method
After registering with New World Telephone, subscribers need simply to start their international call by dialing 009, followed by the applicable country code, area code and local number. For example, to dial Los Angeles from Hong Kong using New World Telephone's IDD 009 service, a subscriber dials 009 + 1 + 213 + the local number.
2.3 Value Added Features
A number of value added service features are included as part of the IDD 009 service. These are 4-digit security/account codes which safeguard against unauthorized access and facilitate departmental billing, access to daily updates of IDD charges through New Word Telephone's 123 Customer Service Hotline and a local time information service for overseas destinations.
2.4 Charges
Registration for IDD 009 service is free of charge. Charges for calls made will be billed to customers on a monthly basis. Subscribers of both IDD 009 and GoCard will be billed together on the same bill. The following table sets out the per minute charges for international destinations, effective December 1, 1995. Charges are calculated on a per six-seconds basis. New World Telephone may well lower charges for various destinations from time to time without publishing them in the Government Gazette. Customers are therefore encouraged to check with New World Telephone's Customer Service Hotline on 123 to confirm the lowest prices available to date.

2.5 Lowering of Tariffs for GoCard
The standard charges applicable to 009 service as listed under section 2.4 are also the revised standard charges applicable to international calls placed by New World Telephone GoCard users. Hence many of the standard rates for GoCard are now lower than the original rates for the GoCard service as published in the Hong Kong Government Gazette Supplement No. 6 of Friday 14 July 1995. These charges may well also be lowered further without New World Telephone publishing them in the Government Gazette. GoCard customers are therefore also encouraged to check with New World Telephone's Customer Service Hotline on 123 to confirm the lowest prices available to date.
2.6 Terms and Conditions of Service
The Customer will observe and be bound by the following terms and conditions in relation to the provision of the service by NWT:
1. Definitions In this Agreement, unless the context otherwise requires:
'Accounts' means the Customer's accounts with NWT in respect of its use of the 009 Service;
'Application' means an application for the 009 Service;
'Customer' means the applicant for the 009 Service and the user of the 009 Service;
'Charges' means the charges for using the 009 Service calculated in accordance with the long distance rates set forth in the Rate Schedule;
'Invoice' means a statement issued by NWT to the Customer providing details of long distance telephone calls made using the 009 Service, and the Charges incurred in relation to the usage of the 009 Service and billed under the Customer's Accounts;
'Rate Schedule' means the schedule setting forth all 009 Service long distance telephone rates to various countries which may change from time to time without notice to the Customer;
'NWT' means New World Telephone Company Limited;
'009 Service' means the international long distance calling service provided by NWT.
2. Provision of the 009 Service
2.1 Upon acceptance of the Application, NWT will connect the Customer's fixed telephone line with the 009 Service, payment for which shall be charged to the Accounts.
2.2 Use of the 009 Service will constitute the Customer's consent to be bound by the terms and conditions of Agreement and, in particular, by the long distance telephone rates set forth in the Rate Schedule.
3. Term
3.1 This Agreement shall come into force on and with effect from the date of acceptance by NWT of the Application and shall continue unless terminated in accordance with the provisions constained herein.
4. Service
4.1 NWT will provide the 009 Service in accordance with the terms and conditions of this Agreement;
4.2 Customer undertakes that he shall not use the 009 Service for any illegal or improper purpose;
4.3 Customer agrees to provide any information as to his identity, his use of the Service and any evidence as to his credit worthiness as may be reasonably requested by NWT;
4.4 Customer shall be solely liable for all Charges incurred in respect of the use of the 009 Service. As such, Customer shall be responsible for monitoring and controlling use of his 009 Service and shall be liable for all Charges incurred through the use of the 009 regardless of whether the Customer personally used the 009 Service or whether the 009 Service was used without his authority, knowledge or consent;
4.5 NWT may impose a credit limit and/or usage limit in respect of Customer's use of the 009 Service and may vary the limit from time to time without notice to the Customer.
5. Suspension
- 5.1
- NWT may suspend access to the 009 Service without notice to the Customer if:
- (a)
- in the reasonable opinion of NWT there is or has been fraudulent or unauthorized access to the 009 Service;
- (b)
- the relevant credit limit or usage limit has been exceeded; or
- (c)
- payment has not been received from the Customer within 30 days of the due date specified in the invoice issued by NWT.
6. Reinstatement of 009 Service
- 6.1
- NWT may reinstate the 009 Service if it is satisfied that the events giving rise to the suspension have been rectified.
7. Payment
- 7.1
- NWT will issue an invoice to the Customer for each month during which there are debits or credits to the Account. The record of transactions on the invoice shall be conclusive and binding on the Customer for all purposes.
- 7.2
- Without prejudice to NWT's right to demand immediate payment at any time, the Customer shall pay to NWT the current balance specified in the invoice on or before the due date specified therein.
- 7.3
- Any enquiries or disputes regarding any invoice must be made to NWT within one month of the issue date of the invoice. Nothing in this Agreement shall relieve the Customer from paying the Charges on or before the payment due date specified in the relevant invoice.
8. Termination of Service
- 8.1
- NWT reserves the right to terminate the provision of the Service forthwith by notice in writing to the Customer at any time:
- (a)
- if the Service has not been used by the Customer for more than 12 months;
- (b)
- if the Customer is in breach of any of his obligations under the Agreement;
- (c)
- if the Service has been suspended in accordance with clause 5 and the events giving rise to suspension have not been rectified within 60 days from the date of suspension.
- 8.2
- NWT or the Customer may terminate this Agreement at any time by giving one month's notice in writing to the other party.
9. Consequences of Termination
- 9.1
- Upon or before date of termination, Customer shall pay to NWT all remaining or outstanding Charges due on the Account.
- 9.2
- Termination hereunder shall be without prejudice to any then existing rights and/or claims that NWT may have against the Customer and shall not relieve the Customer from fulfilling his or her obligations including payment of all outstanding charges prior to date of termination.
10. Changes
- 10.1
- NWT may from time to time, and without notice to Customer, change the terms and conditions in this Agreement including the applicable credit limits and usage limits of the Account, terms of payments, and other charges where applicable. Such changes shall apply on the effective date specified by NWT and shall apply to all outstanding balances on the Account which accrue after the effective date. Customer's continued usage of the 009 Service after the effective date constitutes Customer's acceptance of such changes.
11. Assignment
- 11.1
- NWT may, at any time in its absolute discretion, transfer, assign, delegate or sub-contract any or all of its rights and/or obligations under this Agreement to any of its subsidiaries or associated companies
12. Limitation of liability
- 12.1
- So long as the Company exercises reasonable care in the provision of the 009 Service, and in the Customer's recognition of the fact that technical or administrative difficulties may arise from time to time, NWT shall not incur any obligation or liability whatsoever to the Customer or to any third party for any cost, expenses, loss, damages, compensation or liabilities whatsoever and howsoever caused arising in out of or relating to his or a third party's use of the 009 Service.
- 12.2
- In no event shall NWT be liable to the Customer for any consequential damages or indirect losses which may occur under this Agreement including, without limitation, loss of revenue, contracts, anticipated savings or profits whether or not NWT was or should have been aware of the possibility that such damage or loss could occur.
- 12.3
- Customer undertakes to hold NWT harmless and to indemnify NWT for any liability, loss, damage, cost or expense which NWT may incur in connection with this Agreement. In particular, Customer agrees to hold NWT harmless and to indemnify NWT for any liability, loss, damage, cost or expense which NWT may incur as a result of any misleading, untrue or incorrect information or representations which the Customer gives to NWT in connection with this Agreement.
13. Waiver of remedies
- 13.1
- No forbearance, delay or indulgence by NWT in enforcing the provisions of this Agreement shall prejudice or restrict the rights of NWT nor shall any waiver of its rights operate as a waiver of any subsequent breach and no right, power or remedy herein conferred upon or reserved for NWT is exclusive of any other right, power or remedy available to NWT and each such right, power or remedy shall be cumulative.
14. Force Majeure
- 14.1
- NWT shall not be liable to perform any or all of its contractual obligations, nor shall it be liable for any loss, damage or delay due to or consequent upon strikes, lock-outs, shortage of labor or materials, disputes, delays in delivery of goods or services of any sub-contractor, fire, theft, storm, explosion, war, civil commotion, acts of God or any other circumstances beyond its reasonable control howsoever arising.
15. Dispute Resolution
- 15.1
- In the event the Customer has any disputes with NWT regarding any Charges indicated on its Invoice, computer billing records produced by NWT shall be binding on the resolution of any such disputes.
16. Invalidity
- 16.1
- If at any time any provision of this Agreement is or becomes illegal, invalid or unenforceable in any respect, the legality, validity or enforceability of the remaining provisions of this Agreement shall not be affected or impaired thereby.
17. Interpretation In this Agreement:
- 17.1
- words importing the singular number includes the plural number and vice versa and words importing the masculine includes the feminine and neuter and vice versa;
- 17.2
- where two or more persons are comprised in the expression 'Customer', the Agreement herein contained shall be deemed to be made by such persons jointly and severally;
- 17.3
- headings are for convenience only and do not affect the interpretation of this Agreement;
- 17.4
- in the event of any discrepancy between the English and Chinese version of this Agreement, the English version shall prevail.
18. Representations
- 18.1
- Customer warrants that he is the registered owner/user of his fixed line telephone number to which the 009 Service will be connected, or in the alternative, that he has the registered owner's/user's authorization to use the fixed line telephone number to which the 009 Service will be connected.
19. Governing Law
- 19.1
- This Agreement shall be governed by and construed in accordance with Hong Kong Law.
